BJP MP Gyan Singh’s election canceled from Shahdol

1. High Court observed that nomination of the Independent candidate Mahavir was incorrectly canceled.
Bhopal, March 2, 2019 (Ataullah Faizan): Madhya Pradesh High Court, Jabalpur has canceled the election of BJP MP Gyan Singh from Shahdol Lok Sabha constituency. However, on the appeal of Gyan Singh, the High Court postponed the decision for two weeks to appeal to the Supreme Court.
Mahavir Prasad Manjhi, who contested independents from this seat, challenged Gyan Singh’s election. Mahaveer said that he belonged to the Manjhi caste and the election officer wrongly rejected his nomination. After the hearing on Friday, Justice Atul Sreedharan’s single bench said that rejecting Mahavir Prasad’s nomination papers was totally illegal by declaring caste certificate as the basis. The court said that caste certificate of Mahavir was completely valid and if he got the chance, he could win.
The certificate was valid: the court said that the Supreme Court has given clear guidelines in the matter of Maharashtra against Madhuri Patil, that no officer other than the high level inquiry committee has the right to investigate and abrogate the caste certificate. Mahavir Prasad was issued a caste certificate in 1992 and during this period, the certificate was issued by the Tahsildar Naib. In the year 1996, the General Administration Department had made SDO a competent officer for issuing caste certificates. The objection was made on this basis during the nomination.
What’s next: The court has stayed the decision for two weeks. Gyan Singh will be able to appeal to the Supreme Court over this period.
